By accessing or using Maragogo ("the Service"), operated by Maragogo located in Stafford, Virginia, USA, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Maragogo is an AI-powered travel planning web application that generates personalized day-trip and multi-day itineraries. The Service uses artificial intelligence (Google Gemini) and third-party data sources (Google Places API) to create travel suggestions based on your preferences.

3. Account Registration

To access certain features of the Service, you must create an account through our authentication system. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service
• Interfere with or disrupt the Service or servers connected to the Service
• Use automated systems (bots, scrapers, etc.) to access the Service without our express written permission
• Resell, redistribute, or commercially exploit the Service or its content without authorization
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity

5. AI-Generated Content Disclaimer

The itineraries and travel suggestions provided by Maragogo are generated by artificial intelligence and third-party data sources. While we strive for accuracy, we make no guarantee that:

• Business hours, pricing, availability, or other venue details are current or accurate
• Suggested locations are open, accessible, or suitable for your specific needs
• Travel routes, distances, or time estimates are precise
• Weather forecasts (provided by Open-Meteo) are guaranteed accurate. For safety-critical decisions, consult official weather sources such as NOAA or your local meteorological service

You are solely responsible for independently verifying all information before relying on it for travel decisions.

6. Payments and Credits

Certain features of the Service may require payment. Payments are processed through Stripe, a third-party payment processor. By making a purchase, you agree to Stripe's Terms of Service. All fees are stated in US dollars unless otherwise noted.

• Refunds: Refund requests may be submitted to [email protected] within 14 days of purchase. Refunds are granted at our discretion.
• Credits: Credits are purchased as one-time payments. There are no recurring charges or auto-renewals. Unused credits remain in your account indefinitely. Credits are non-refundable once used for AI-powered actions (generation, regeneration, venue swap).

7. Intellectual Property

The Service, including its design, logos, text, graphics, and software, is the property of Maragogo and is protected by US and international intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.

Itineraries generated for you through the Service are provided for your personal, non-commercial use.

8. Third-Party Services

The Service integrates with third-party services including Google Places API, Google Gemini AI, and Stripe. Your use of these services is subject to their respective terms and privacy policies. Maragogo is not responsible for the practices or content of any third-party services.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Maragogo and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of or inability to use the Service.

In no event shall our total liability exceed the amount you paid to us in the twelve (12) months preceding the claim, or fifty US dollars ($50), whichever is greater.

10. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

You agree to indemnify and hold harmless Maragogo and its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service or violation of these Terms.

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, with or without notice, for conduct that we determine violates these Terms or is harmful to the Service, other users, or third parties.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Virginia.
